Give it similar or greater size and visibility. Keep advertising under broker supervision. Review team wording, social posts, and listing permissions before publishing your website. Sources read: **2026.10.10**. Each citation repeats that date. Quotes are short excerpts; open each source for its complete conditions. The commission's linked license manual places the advertising rule in Title 299, Chapter 2, §004. Older commission guidance cites §003. This article uses the manual's numbering. [NREC license manual, December 2025 edition, Chapter 2, PDF pages 12-14, read 2026.10.10](https://nrec.nebraska.gov/sites/default/files/doc/Legal/License%20Manual%20PDF/2licensemanualrulestitle299.pdf#page=12). ## Show the brokerage beside the agent or team name Neb. Rev. Stat. §81-885.24(33) makes advertising that fails to **“prominently display”** the designated broker's filed business name disciplinary grounds. Subdivision (34) also addresses team advertising suggesting an **“independent real estate brokerage”**. [Neb. Rev. The commission's illustrated guidance rejects a webpage example with the brokerage name smaller than the affiliated licensee's name. Its accepted example displays the brokerage prominently. For implementation, check each advertising page on a phone and desktop. A large agent headline and a small brokerage footer need review. Check the rendered names, logos, contrast, and spacing together. These are proposed checks, rather than a prescribed pixel size. Confirm with your broker. ## Preserve the guidance's exception for repeated team names The commission's illustrated exception concerns additional team-name mentions on the **“same page”**. It permits those mentions without repeated adjacency when the team and brokerage names satisfy adjacency and similar size at the page's top. Every later team-name mention must remain no larger or more prominent than the brokerage name. That example concerns repetition within one page. Check a separate landing page, property page, or advertisement as its own display. Confirm with your broker. ## Check the team name and your advertised personal name The rules address both branding and recorded names: | Provision | Quoted excerpt | Requirement to check | | --- | --- | --- | | 299 NAC 2-004.07a | “always” | Team advertising includes the team name recorded with its designated broker. | | 299 NAC 2-004.08a | “team”, “group” | The team name includes one of these words. | | 299 NAC 2-004.08b | “Realtors”, “Company”, “Corporation”, “Corp.”, “Inc.”, “LLC”, “LP”, “LLP” | These words are prohibited in team names, along with similar words suggesting a separate brokerage or company. | | 299 NAC 2-004.08c | “immediately followed” | If the name uses real estate or realty, team or group immediately follows that term. | | 299 NAC 2-004.07d | “legal name” | Record an advertised alternative name with the commission. The commission's naming guidance says team names stay current on file with the designated broker. It does not require submitting team names to the commission. Compare the website logo, page headings, social account names, and recorded team name. Confirm with your broker. ## Use broker supervision for the website and its advertisements 299 NAC 2-004 requires **“direct supervision”** of advertising by the broker. Its definition covers public identification, representation, **“promotion”**, and solicitation related to licensed real estate activity. [299 NAC 2-004, PDF page 12, read 2026.10.10](https://nrec.nebraska.gov/sites/default/files/doc/Legal/License%20Manual%20PDF/2licensemanualrulestitle299.pdf#page=12). The commission FAQ says affiliated licensees must advertise under the broker's recorded business name. Independent-contractor status does not provide an exception. The commission posts internet recommendations that are **“NOT Guidelines mandated”** by it. Those recommendations describe website approval before activation and ongoing monitoring. They support a review workflow; they do not establish a universal signed approval form for each advertisement. Prepare the pages and ad creatives for your broker's review before publication. Keep the reviewed version with the resulting decisions. Confirm with your broker. ## Include the brokerage in the social advertisement itself The commission's December 2021 social guidance states there is no **“one click away”** rule in Nebraska. It places brokerage identification in the first public-facing display. Its examples cover tweets, Facebook reposts, Instagram, and Snapchat. It also says audio should name the brokerage and video should name or prominently show it. Older optional internet recommendations discuss profile-based disclosure differently. Use the later social guidance when reviewing advertising posts. Include promotions of your services, brokerage, or properties. Inspect what a viewer sees before following a link. Confirm with your broker. ## Verify property permission and IDX display instructions Neb. Rev. Stat. §81-885.24(12) addresses offering property for sale or lease without the owner's or authorized agent's **“knowledge and consent”**. Subdivision (2) addresses intentionally using materially **“misleading or inaccurate”** advertising. [Neb. Rev. Stat. §81-885.24(2), (12), read 2026.10.10](https://www.nebraskalegislature.gov/laws/statutes.php?statute=81-885.24). The optional internet recommendations call for permission when displaying another licensee's listings and retaining the listing brokerage's identification. They also discuss current listing information. Their optional status matters. [NREC Internet Best Practices Recommended Guidelines, Currency and Accuracy of Information, read 2026.10.10](https://nrec.nebraska.gov/legal/commission-statutes-rules-and-regulations-and-other-references). For an IDX page, collect the feed agreement, display instructions, and a sample listing. These are proposed review materials. A universal Nebraska IDX disclaimer, attribution format, or refresh interval remains **UNRESOLVED** in the checked sources. Confirm with your broker. ## Review fair-housing language and the logo question Neb. Rev. Stat. §20-318(3) prohibits dwelling advertisements indicating a **“preference, limitation, or discrimination”** based on protected characteristics. The statute names race, color, religion, national origin, disability, familial status, sex, and military or veteran status. Read its referenced exemptions with the complete provision. [Neb. Rev. A universal fair-housing logo mandate remains **UNRESOLVED** here. Requirements attached to a particular program, feed, or brokerage also remain open. Put the proposed logo and statement in the review. Confirm with your broker. ## Keep license-number display as a separate question The checked advertising provisions do not establish a general requirement to display a license number on every agent website or online advertisement. This finding covers 299 NAC Chapter 2, §§004-007 and §81-885.24's advertising clauses. Stat. §81-885.24, read 2026.10.10](https://www.nebraskalegislature.gov/laws/statutes.php?statute=81-885.24). For advertisements involving your own property, §006 separately requires disclosure of your licensee capacity and role as a **“principal”**. That is a different disclosure from a license number. [299 NAC 2-006, PDF page 14, read 2026.10.10](https://nrec.nebraska.gov/sites/default/files/doc/Legal/License%20Manual%20PDF/2licensemanualrulestitle299.pdf#page=14). Any additional license-number display requirement remains **UNRESOLVED** until the relevant broker or program instructions are available. Confirm with your broker. ## Apply a short site checklist - Match the brokerage display to its name recorded with the commission. - Compare brokerage and agent or team names for adjacency, size, and visibility on each advertising display. - Review repeated team names against the commission's exception for one page. - Match team and personal branding to the applicable naming rules and records. - Review social advertisements before a viewer follows any link. - Check property permissions, listing accuracy, and IDX instructions. - Record the broker's decisions on approval, license-number display, fair-housing wording, and logos. ## Bring the reviewed pages into the website fix Prepare a page inventory, the approved brokerage display, team records, ad examples, and unresolved questions.
