Commission guidance applies that name requirement to every viewable page of a website you own or control. Start by checking the name your site displays and the pages where it appears. ## Separate the statute from Commission guidance Idaho Code §54-2053 contains the advertising requirements. The current administrative chapter is IDAPA 24.37.01, Rules of the Idaho Real Estate Commission. Read 2026.10.10. ## Display the licensed brokerage name clearly Idaho Code §54-2053(2) states: > All advertising of listed property shall clearly and conspicuously contain the broker’s licensed business name. A new business name shall not be used or shown in advertising unless and until a proper notice of change in the business name has been approved by the commission. Branch-office advertising has its own express requirement in §54-2053(3): > All advertising by licensed branch offices shall clearly and conspicuously contain the broker’s licensed business name. Guideline #13, FAQ 1, identifies the required name as “The broker’s full licensed business name.” FAQ 10 says it belongs on “every viewable page” of a licensee-controlled website. As a practical check, open the homepage, contact page, landing pages, and property pages directly. Inspect desktop and mobile layouts. Check contrast, legibility, and whether menus or overlays cover the name. The reviewed Idaho sources do not prescribe a fixed font size or placement beside each phone number. A particular header or footer design is a layout choice. Confirm with your broker. ## Keep team branding and agent names accurate Guideline #13, FAQ 2, allows team branding as “supplemental information”; it cannot replace the full brokerage name. Read 2026.10.10. UNRESOLVED: The reviewed sources do not establish a separate statewide list of prohibited team-name words or a team-to-brokerage font-size ratio. Confirm with your broker. ## Check whether a license number belongs on your site UNRESOLVED: A universal requirement to display an individual agent’s license number on an ordinary website was not established by the reviewed sources. Those sources were §54-2053, IDAPA 24.37.01, and Guideline #13. The absence of a rule in these sources does not settle every program or contractual requirement. ## Confirm the broker’s advertising review process Idaho Code §54-2038(1)(a) requires the designated broker to: > Supervise and control, in the manner required by law and rule, all office locations, and the activities of all licensees and unlicensed persons associated with that brokerage company or for whom that designated broker is responsible; Source: [Idaho Code §54-2038(1)(a)](https://legislature.idaho.gov/statutesrules/idstat/Title54/T54CH20/SECT54-2038/). Read 2026.10.10. Subsection (1)(b) requires approval of real estate agreements. Read 2026.10.10. That agreement provision does not expressly require written preapproval of every advertisement. UNRESOLVED: The reviewed provisions do not establish that universal advertising procedure. Confirm with your broker how website changes and advertisements receive review. ## Apply the social-media exception only when space is insufficient Guideline #13, FAQ 11, calls for prominent brokerage identification when space permits. It allows the name “one click away” when the platform lacks sufficient space on the initial page. During review, open the profile and individual advertisements as a visitor. Test the disclosure link yourself. Confirm with your broker before using a linked disclosure for a constrained format. ## Review IDX pages and third-party listing displays Guideline #13, FAQ 13, says MLS and other third-party sites displaying MLS data “shall be monitored” for timely updates and Idaho compliance. UNRESOLVED: These state sources do not establish a universal IDX attribution template, copyright line, or numerical refresh interval. Confirm with your broker which MLS and feed requirements apply. Review an active listing, a changed listing, and a removed listing in the rendered feed. Keep a record of the page, review date, and corrections requested. ## Check fair housing language and unresolved logo requirements Idaho Code §67-5909 prohibits discrimination on specified grounds. Its opening identifies race, color, religion, sex, and national origin. It also applies disability protection to subsection (8). For owners, others engaging in real estate transactions, brokers, and salesmen, §67-5909(8)(f) prohibits: > To print, circulate, post or mail or cause to be so published a statement, advertisement or sign, or to use a form of application for a real estate transaction, or to make a record or inquiry in connection with a prospective real estate transaction, which indicates, directly or indirectly, an intent to make a limitation, specification, or discrimination with respect thereto, Source: [Idaho Code §67-5909, opening and (8)(f)](https://legislature.idaho.gov/statutesrules/idstat/Title67/T67CH59/SECT67-5909/). Read 2026.10.10. Review property descriptions, audience language, and inquiry forms for discriminatory restrictions. UNRESOLVED: The reviewed Idaho sources do not establish a universal Equal Housing Opportunity logo or statement requirement for every agent website. Applicable federal, housing-program, association, or brokerage requirements remain outside this source review. Confirm with your broker which logo or statement applies to your site and advertisements. ## Remove misleading advertising Idaho Code §54-2053(4) states: > No advertising shall provide any information to the public or to prospective customers or clients that is misleading in nature. Check claims and property details against current records. Include mobile pages and advertisements in that review. ## A short checklist for your site Use these as review steps. They are applications of the quoted sources, not additional Idaho rules. - Compare the displayed brokerage and agent names with current licensing records. - Open each page directly on desktop and mobile. Check brokerage-name legibility. - Review team branding and any displayed license numbers with your broker. - Confirm your broker’s process for reviewing website edits and online advertisements. - Test social-media disclosures from the visitor’s view. - Check IDX updates and confirm the applicable feed disclosures with your broker. - Review housing copy and forms. Confirm any required fair housing logo or statement with your broker. - Record corrections to misleading claims and outdated property information.
