Check the business name, page layout, and broker approval together. Read 2026.10.10. ## Read the current rule and the adopted advertising guide The official Code of Arkansas Rules records §220-1004 as effective 2026.09.20. Older Commission publications call the advertising provision Rule 10.5. This article uses the current citation and labels the guide separately. Read 2026.10.10. AREC adopted advertising policy AREC-L-AD-001 on 2025.08.11. It directs staff to use the July 2025 Advertising Best Practices Guide when assessing advertising violations. The policy says the guide: > shall be utilized in defining the license law and Commission Rules The policy also permits the Executive Director to consider exceptions for extenuating circumstances. These are adopted enforcement instructions. They do not turn every recommendation containing “should” into a separately numbered administrative rule. Read 2026.10.10. ## Use the firm's licensed name and show your connection Section 220-1004(a) requires property advertisements and real estate or property-management signs to include the: > name of the firm Section 220-1004(b) requires brokerage business and advertising to use the: > name in which the principal broker's license has been issued Section 220-1004(c) conditions use of individual names or telephone numbers on an obvious broker connection. Its wording includes: > connection with the broker is obvious These are short excerpts. Read their full clauses together. A personal brand does not replace the licensed firm name. Use the broker-confirmed name in your business website's advertising. Read 2026.10.10. ## Check placement on every page The guide requires the full firm name on “every page” and clear licensee identification. Firm-name prominence should be “equal to or greater than” agent or team names, in “close proximity”. Include firm contact information: its main phone, office address, or website. Inspect the homepage, contact page, landing pages, and property pages on desktop and mobile. Check the visible result after menus and inquiry controls open. These are suggested inspection steps. The rule does not prescribe a particular header, footer, or fixed navigation design. ## Keep advertising claims accurate Arkansas Code §17-42-311(a)(10) prohibits: > Advertising in a false, misleading, or deceptive manner Review property descriptions, affiliation claims, and service promises alongside your disclosure block. Accuracy applies to the advertising content as well as its presentation. Read 2026.10.10. ## Treat license-number display as a separate question Section 220-1004 identifies the firm name and agent-broker connection. It does not prescribe an agent's license number in an ordinary website advertisement. The reviewed advertising provisions and guide do not establish a general number-display mandate. For those details, confirm with your broker. ## Keep a team name distinct from the firm The guide rejects team branding that could be “construed as a real estate firm name”. For the proposed name and its presentation, confirm with your broker. ## Obtain broker approval for the website Section 220-1003(b)(2) requires supervising brokers to: > exercise strict supervision That duty concerns the activities of licensees for whom they have supervisory responsibility. The cited supervision rule does not prescribe a universal written signoff form for every post. ## Test social media disclosures in their published format The guide places prominent firm information near agent or team information on the profile or landing page, accessible within “one click or one tap”. Open a proposed post, advertisement, image, and video on a phone. Follow its disclosure path. These are suggested format checks. Where the platform's presentation leaves the path unclear, confirm with your broker. ## Check IDX authority and listing attribution An IDX display still advertises properties. Section 220-805(b) says a licensee: > shall not offer or advertise property without authority The same subsection ties the advertised price to the owner's agreed offering price. Inspect complete search and detail pages before approving the display. ## Check fair housing content and any required symbol separately The Commission's published fair housing summary identifies advertising that indicates a: > preference, limitation or discrimination It addresses race, color, religion, sex, disability, familial status, and national origin. Review housing descriptions and images against those protections. Record the applicable logo or statement requirement before approving its placement. ## A short checklist for your own site - Compare the displayed firm name with the licensed name. - Inspect each page's disclosure block, prominence, contact details, and mobile layout. - Check team branding against the firm-name guidance above. - For website approval and later changes, confirm with your broker. - Follow the social disclosure path and inspect IDX listing attribution. - Review housing copy and images for discriminatory preferences. - For number-display policy, feed rules, and any required housing symbol or statement, confirm with your broker.
