# Keep your SEO work inside copyright, privacy, disclosure, and trademark law.

SEO work focuses on rankings and traffic. It also touches four bodies of law. Copyright covers the content, and privacy law covers the analytics. Advertising law covers affiliate pages, and anti-spam law covers outreach email. A traffic gain does not cover the cost of an enforcement action, a lawsuit, or the damage to your brand.

This guide lists the legal areas that SEO work meets most often, and the practices that keep you inside them. It is not legal advice. Take the specific decisions to counsel.

## Respect copyright in content and images

Copyright protects an original creative work automatically. The author does not need to register it. If you use another person's content without permission or a fair use basis, you risk an infringement claim.

### Own your content

Original content is the only complete protection. Content that employees create as part of their job normally belongs to your organization as work made for hire. Content from contractors is different. It belongs to you only if the contract transfers the copyright, for example through explicit work-for-hire language or an assignment.

### Know the limits of fair use

Fair use permits limited use of copyrighted material for commentary, criticism, news reporting, teaching, or research. Courts weigh four factors:

1. The purpose and character of the use: is it transformative, and is it commercial?
2. The nature of the copyrighted work: factual or creative.
3. The amount used, relative to the whole work.
4. The effect on the market value of the original.

Fair use depends on the case, and a court decides it after the fact. It is uncertain protection.

Attribution is not fair use. A short quote with attribution can support a fair use argument. Attribution does not give you permission to reproduce a substantial part of a work. A link credits the source without copying its expression. When you are unsure, link instead of quoting at length.

### License every image

Images need a license or your own photography. Stock images from Shutterstock or Getty Images come with license terms that you must follow. The Unsplash License does not require attribution, but it forbids some uses, such as the sale of unaltered copies. An image in Google Images is still under copyright; the search result gives you no rights. Commission photography or illustration for original visuals.

### Answer DMCA notices

When you receive a valid takedown notice under the Digital Millennium Copyright Act (DMCA), remove the content promptly. If the notice is wrong, file a counter-notice. If you ignore a valid notice, you face direct infringement liability, including statutory damages under 17 U.S.C. § 504(c), which rise sharply for willful infringement. Hosting providers must act on notices to keep their safe harbor, so they may remove the content or end your account. Google also uses the number of valid removal notices as a ranking signal. Prevent infringement with a content review process instead of reacting to notices.

## Handle EU visitor data under GDPR

The General Data Protection Regulation (GDPR) sets its territorial scope in Article 3. Article 3(1) applies when you process personal data in the context of your establishment in the EU. The processing itself does not need to take place in the EU. An establishment can be small. In some cases, one employee or agent in the EU who acts with enough stability is sufficient.

Article 3(2) applies to a business with no EU establishment in two cases. The first case is an intentional offer of goods or services to people in the EU, paid or free. Signs of that intent include an EU language or currency, delivery to EU countries, and advertising aimed at an EU country. The second case is the monitoring of their behavior in the EU, such as tracking cookies, behavioral advertising, or profiling. A website that people in the EU can open is not, by itself, an offer to them. Personal data of one EU visitor is also not sufficient without an offer or monitoring.

Blocking EU traffic on your website is not a universal exemption. It does not change Article 3(1) scope when you have an EU establishment. It also does not cover offers that reach people in the EU through other channels, such as marketing email. The European Data Protection Board (EDPB) explains these tests in [Guidelines 3/2018 on the territorial scope of the GDPR (Article 3)](https://www.edpb.europa.eu/documents/guideline/guidelines-32018-on-the-territorial-scope-of-the-gdpr-article-3-version-adopted_en), adopted after public consultation on 12 November 2019. Many US businesses apply GDPR practices globally instead of managing regional rules. The maximum fine is 4% of worldwide annual turnover or the fixed cap in Article 83, whichever is higher.

### Get consent before non-essential cookies

Analytics, advertising, and tracking cookies need opt-in consent before they load. Cookies essential to the site's function, such as the shopping cart and login, do not need consent. The banner must offer a real choice:

- No pre-checked consent boxes.
- No cookie wall that blocks the content until the visitor accepts. European regulators treat cookie walls as generally non-compliant.

### Sign data processing agreements

Google Analytics, Google Ads, and marketing automation platforms process EU visitor data. Confirm that each tool offers a data processing agreement (DPA) that makes it a GDPR processor, and sign it. Check how each tool transfers data out of the EU. Before July 2023, several EU regulators found Google Analytics transfers to the US unlawful. The EU-US Data Privacy Framework, adopted on 10 July 2023, covers transfers to US companies certified under it.

### Write a complete privacy policy

The policy must state:

- What data you collect.
- How you use it.
- Which third parties receive it.
- How long you keep it.
- The user's rights: access, deletion, and portability.
- Who to contact with privacy questions.

Generic templates often miss GDPR requirements. Ask privacy counsel to review the policy.

### Honor deletion requests

EU residents can ask you to delete their personal data. Set up a procedure:

1. Verify the requester's identity.
2. Find every system that stores their data.
3. Delete the data without undue delay, within one month of the request.
4. Confirm the deletion to the requester.
5. Record the request and your response for audits.

GDPR allows an extension of up to two more months for complex requests, if you tell the requester.

### Collect only what you need

Do not collect data in case it becomes useful. Every form field needs a defined purpose. Shorter forms also convert better, and they reduce your compliance work.

## Disclose paid relationships under FTC rules

The Federal Trade Commission (FTC) requires clear disclosure of material connections between an endorser and an advertiser. An undisclosed affiliate relationship or undisclosed sponsored content is deceptive advertising. The FTC revised its Endorsement Guides in June 2023.

### Disclose affiliate links

When you earn a commission from a recommended product, disclose it. The disclosure must be:

- Clear and conspicuous, not hidden in the footer or the terms of service.
- Close to the recommendation, before or beside the affiliate link, not on a separate page.
- In plain language: "I earn a commission if you buy through this link", not "affiliate partnership disclosure".

Mark affiliate links with `rel="sponsored"` or `rel="nofollow"` too. A commission is a payment, so Google treats affiliate links as paid links. Disclosed affiliate links still bring traffic and revenue.

### Label sponsored and native content

Label content that a brand paid for: "Sponsored by [Brand Name]" or "Paid Partnership". "Presented by" or "brought to you by" may not tell readers that the content is paid. Readers must recognize advertising without a click on a disclosure link.

Content that looks like editorial content needs a clear label, such as "Advertisement" or "Sponsored Content". The FTC has taken action against companies that used unclear labels such as "promoted" or "featured".

### Require disclosure from influencers

When you pay an influencer for a mention or review, the contract must require an FTC-compliant disclosure. You share liability when the influencer fails to disclose. Monitor their posts to confirm the disclosures.

### Keep testimonials representative

A "results not typical" disclaimer is not enough. If a testimonial shows results that most customers do not get, the FTC expects you to disclose the results customers can generally expect. A better practice is to show typical experiences, not outliers. The FTC watches weight loss, income opportunity, and health claims most closely. Since 21 October 2024, an FTC rule also prohibits fake reviews and testimonials. It also bans payment conditioned on a positive or negative review.

## Build links within Google's rules and spam law

Google's spam policies prohibit link schemes and manipulative link building. The policies are not law, but a violation can cost rankings. Some link practices also break advertising or computer fraud law.

Mark every paid link with `rel="sponsored"` or `rel="nofollow"`. A paid link that passes PageRank violates Google's policies and can also fail FTC disclosure rules. A disclosed paid link still brings exposure and referral traffic.

Avoid link exchanges done mainly for rankings, such as "I'll link to you if you link to me" arrangements. Natural links between related sites are fine. Arranged exchanges risk a penalty. Earn links with content instead.

Do not use software that posts forum signatures, blog comments, or directory submissions automatically. These links break most sites' terms of service and Google's policies. They harm more than they help. Manual outreach based on real relationships produces better links.

### Follow CAN-SPAM in outreach email

The CAN-SPAM Act applies to cold outreach for backlinks and guest posts. Each email must:

1. Show accurate sender information.
2. Give a clear way to unsubscribe.
3. Include a physical postal address.

Honor each opt-out request within 10 business days. Civil penalties apply per email, and the FTC adjusts the amount for inflation each year.

### Never attack competitors

Hacking a competitor's site or flooding it with traffic in a denial-of-service attack can be a crime under the Computer Fraud and Abuse Act (CFAA). Spam links built to harm a competitor's rankings, and scraped copies of their content, can also create legal liability.

## Make the site accessible

US courts have applied the Americans with Disabilities Act (ADA) to websites, although the requirements for private businesses remain unsettled. Demand letters and lawsuits about inaccessible websites have increased substantially. The risk is higher for consumer businesses than for business-to-business sites, and higher for businesses with physical locations.

The Web Content Accessibility Guidelines (WCAG) at Level AA are the working standard. WCAG 2.1 is widely cited. The current W3C Recommendation is WCAG 2.2, in a version dated December 2024. The guidelines rest on four principles:

| Principle | Meaning | Examples |
|---|---|---|
| Perceivable | Users can perceive the information | Alt text for images, captions for video |
| Operable | Users can operate the interface | Keyboard access, enough time to read |
| Understandable | Users can understand the content and controls | Clear language, predictable navigation |
| Robust | Content works with assistive technologies | Valid, semantic markup |

Accessibility work often improves SEO too. Alt text helps screen readers and image search. Semantic HTML helps assistive technology and search engines. A clear heading hierarchy helps navigation tools and search engines. Captions help deaf users and add searchable text. Automated tools such as WAVE and axe DevTools find many technical problems, but not all. Add manual tests:

1. Use the whole site with the keyboard only.
2. Test with screen readers, such as NVDA, JAWS, and VoiceOver.
3. Confirm that content still makes sense at 200% zoom.

Publish an accessibility statement. State the conformance level you target, the known limitations, how to report a barrier, and who to contact. A statement does not prevent lawsuits, but it shows good faith.

## Use trademarks carefully

Trademark law protects brand names to prevent consumer confusion. Competitor trademarks in SEO need care.

You can generally use a competitor's trademark in content to compare or discuss their product. This is nominative fair use. It requires three conditions:

1. You cannot identify the product without the trademark.
2. You use only as much of the mark as you need.
3. You do not suggest sponsorship or endorsement by the trademark owner.

An article titled "How [Your Product] Compares to [Competitor Brand]" usually qualifies. A page that suggests sponsorship, creates confusion, or exists only to capture the competitor's brand traffic does not.

Google Ads allows bids on competitor trademarks as keywords. It restricts trademarks in ad text when the owner complains, with exceptions such as authorized resellers. This prevents impersonation and leaves room for comparison advertising. Many businesses agree with each other not to bid on each other's names, even where it is legal.

Do not register domains that contain a competitor's trademark to profit from confusion. That can violate the Anticybersquatting Consumer Protection Act (ACPA). Signs of bad faith include an offer to sell the domain to the trademark owner, no legitimate use, and typo variations of the brand. Register variations of your own brand defensively.

Do not put competitor names in title tags or hidden text only to rank. In some jurisdictions, that manipulation is trademark infringement. Use competitor names only when you really compare or discuss their products.

Answer a trademark complaint or cease-and-desist letter. Do not ignore it. Ask trademark counsel whether your use infringes, whether a fair use defense applies, and how to respond. A small change often resolves the dispute. In other cases, a legitimate fair use deserves a defense.

## Check the rules for your industry

Some industries have marketing rules beyond general consumer protection law.

| Industry | Regulators | Main limits on SEO content |
|---|---|---|
| Financial services | SEC, FINRA, CFPB | No promised returns. Disclose risks. Keep compliance approval records. The SEC Marketing Rule restricts hypothetical and selected performance results for investment advisers. |
| Healthcare and pharmaceuticals | FDA, FTC | Health claims need adequate clinical evidence. "This product treats [condition]" is a drug claim that needs FDA approval. Supplement structure and function claims need an FDA notification and a disclaimer. |
| Alcohol and tobacco | Federal and state regulators | Alcohol content must not appeal to minors or link drinking to social or sexual success. Brand sites may need an age gate. Tobacco advertising is severely limited. |
| Services for children | FTC, under COPPA | For children under 13: get verifiable parental consent, disclose data practices, protect the data, and let parents review and delete it. The FTC amended the COPPA Rule effective June 2025, with most compliance due by 22 April 2026. Analytics on child-directed pages must comply. |
| Licensed professions | State bars, medical boards, other licensing bodies | Advertising rules beyond general law. Review them before any SEO work. |

## Decide when to get a legal review

Get a lawyer's review of your SEO practices in these cases:

- You work in a regulated industry, such as finance, healthcare, or law.
- You serve visitors in several jurisdictions, including the EU.
- Your operation is large enough that one violation creates significant liability.
- Your site depends on third-party content, user-generated content, or affiliate marketing.

A one-time review that sets up compliant practices costs much less than an enforcement action or a lawsuit defense.
