# Rent-back agreement: a seller FAQ for your agent website

A rent-back agreement lets a seller remain in the home temporarily after the sale closes, renting it from the buyer. The occupancy dates and responsibilities need their own written explanation. [Rocket Mortgage's rent-back definition and terms](https://www.rocketmortgage.com/learn/rent-back-agreement). [TREC Form 15-7, Seller’s Temporary Residential Lease](https://www.trec.texas.gov/sites/default/files/pdf-forms/15-7.pdf), checked 2026.10.14.

On your agent website, answer that question first. Then show which dates, costs, and responsibilities need professional review. Give sellers and buyers separate ways to ask about their move.

The website requirements below are recommendations. This article provides no legal advice. **Confirm the local explanation with your broker or attorney before publishing it or applying it to an agreement.**

## Which dates should the FAQ distinguish?

Put the closing date and the proposed end of seller occupancy in separate fields. Ask for the buyer's intended move-in date separately. Label an unknown date as unknown.

In the Texas example, TREC Form 15-7 starts the lease when the sale closes and funds. It provides a separate termination-date blank. That wording belongs to the Texas form. [TREC Seller's Temporary Residential Lease, paragraph 3](https://www.trec.texas.gov/sites/default/files/pdf-forms/15-7.pdf). [TREC Seller's Temporary Residential Lease, paragraph 3](<https://www.trec.texas.gov/sites/default/files/pdf-forms/15-7.pdf>). checked 2026.10.14.

For your page, propose a simple timing worksheet:

| Date or event | Information to confirm | Question for review |
| --- | --- | --- |
| Proposed closing | The date in the purchase agreement and whether it remains tentative | When would post-closing occupancy begin under the applicable document? |
| Requested occupancy end | The seller's requested departure date | Does the request fit the relevant form and transaction requirements? |
| Buyer move-in | The buyer's intended possession and moving plans | What must be confirmed before agreeing to the requested stay? |
| Next-home availability | The seller's reported timing and unresolved conditions | What happens if that home is unavailable on the expected date? |
| Property handover | The proposed condition check and key handover | Who confirms that possession has been delivered? |

Treat these as discussion fields. Keep a requested date separate from an agreed date. Ask the reviewing agent to identify what evidence supports each entry.

Use the FAQ for post-closing occupancy. Keep changing the purchase closing date and accepting a home-sale contingency in their own explanations.

## How do you make the answer local?

Listing agreements vary by state. [NAR's listing-agreement guide](https://www.nar.realtor/the-facts/consumer-guide-listing-agreements), checked 2026.10.14. NAR qualifies its listing-agreement guidance by state and local law. Its contingency guide recommends attorney review of contract terms. [NAR's contract-contingency guide](https://www.nar.realtor/the-facts/consumer-guide-real-estate-contract-contingencies), checked 2026.10.14.

For rent-back wording, start with the applicable commission or state REALTOR association form page. The Texas Real Estate Commission lists **Seller's Temporary Residential Lease, Form 15-7**, effective **2026.01.05**. The page limits this form to seller occupancy of no more than 90 days after closing. Sources checked **2026.10.14**. [TREC's current form page](https://www.trec.texas.gov/forms/sellers-temporary-residential-lease).

That form limit does not establish whether a proposed stay fits a buyer's financing. Ask the buyer to obtain the lender's confirmation for the actual transaction. Leave any unverified financing deadline out of the public answer.

Give your local answer a source record: state, document name, form identifier, effective or revision date, date checked, and review owner. Have the broker or attorney approve the wording against the current document.

For an agent serving multiple states, provide a reviewed source record for each state explanation. Publish only the local answers that have completed review.

## What costs and responsibilities should the page address?

TREC Form 15-7 separates rental, deposit, utilities, property condition, inspections, repairs and maintenance, insurance, and holding over. It warns that seller possession as tenant may change insurance coverage. [TREC Form 15-7, paragraphs 4–6, 9, 12, 14, 16, and 19](https://www.trec.texas.gov/sites/default/files/pdf-forms/15-7.pdf), checked 2026.10.14.

Use those subjects to prepare questions for your own state's reviewer. The worksheet below proposes FAQ requirements. It supplies no contract language or recommended amounts.

| FAQ subject | Question to answer from the applicable document |
| --- | --- |
| Occupancy payment | What payment basis, due date, and early-departure treatment need explanation? |
| Deposit | Who receives or holds it, and what governs deductions and return? |
| Utilities | Who pays each service, and when should any account change occur? |
| Maintenance and damage | How does the document assign upkeep, repairs, and damage responsibility? |
| Access | How are inspection access, notices, keys, and codes handled? |
| Insurance | What should each party confirm with their insurance professional? |
| Departure | What condition, belongings removal, and possession handover need confirmation? |
| Missed departure or extension | What approved process applies if the requested timing changes? |

Have the reviewer write the answers. Keep unknown costs visible until verified. Avoid adding a default deposit, daily payment, or overstay multiplier to the page.

Do not use a mortgage-payment calculation as an automatic recommendation for occupancy payment. Ask the agent to explain the agreed approach using the actual documents.

## How should the FAQ handle a delayed move or missed departure?

Provide a question route for a seller whose next home may be delayed. Give buyers a route for questions about receiving possession. Ask the reviewer to explain extensions, notice, and remedies under the applicable agreement.

For the Texas example, paragraph 19 has a blank daily amount for possession after termination. The form does not supply a universal amount for the website to recommend. [TREC Form 15-7, paragraph 19](https://www.trec.texas.gov/sites/default/files/pdf-forms/15-7.pdf). [TREC Seller's Temporary Residential Lease, paragraph 3](<https://www.trec.texas.gov/sites/default/files/pdf-forms/15-7.pdf>). checked 2026.10.14.

Keep this answer focused on arranging review. Do not publish a self-help removal procedure or imply that submitting a website inquiry changes the signed occupancy terms.

Ask the receiving brokerage to approve how deadline-sensitive questions reach a person. Put its agreed contact route beside the FAQ. Publish a response-time commitment only when the receiving team can honor it.

## What should a seller or buyer inquiry contain?

Propose two buttons: **Ask about staying after I sell** and **Ask about a seller staying after I buy**. Use wording that matches the receiving agent's approved services.

Request the visitor's role, property state, question, and preferred reply method. Offer optional fields for proposed closing, requested departure, and intended move-in. Include “Not sure” for dates and whether terms are already agreed.

Carry the selected role, dates, and FAQ page address into the received message. Name the recipient. Keep signed agreements, financial records, and insurance documents out of the initial website form.

Use these editorial prompts if the brokerage approves them:

- Seller: “What timing do you need after closing, and which date remains uncertain?”
- Buyer: “When do you intend to move in, and what do you want reviewed about the seller's requested stay?”

Explain the next step as a discussion with the receiving agent. Arrange any document exchange through the brokerage's approved private process. Keep inquiry receipt separate from contract review, lender confirmation, or agreement to the request.

## How do you accept the completed page?

Ask the builder and reviewers to demonstrate the following checks. These are requirements for a future website build, with no completed implementation claimed here.

| Check | Evidence to request |
| --- | --- |
| Public answer | Post-closing occupancy is explained before the contact form |
| Local source | The current official form page, version, check date, and reviewer approval are recorded |
| Dates | Requested and agreed dates remain distinct; unknown values stay visible |
| Responsibilities | Published answers match the reviewer's approved version |
| Seller and buyer routes | Marked test inquiries reach the agreed recipient with the selected role and question |
| Phone and keyboard use | Source links, labels, fields, validation, and submission results remain usable |
| Maintenance | A named person owns source checks and renewed review when wording changes |

Use test details you control. Compare each received message with the submitted values. Include an inquiry with unknown dates and a failed-submission check. Save proof of receipt after any defect is corrected.

## Include the seller rent-back FAQ

The rent-back FAQ identifies occupancy timing and local contract questions requiring professional review. Include the approved seller explanation at [whole website fix: rent-back timing](/for/real-estate). The whole website fix tests inquiry arrival at the agreed destination.
