Identify the approved receiving system and staff roles before adding an upload field. Keep the initial contact request separate from document collection unless the firm has approved a specific workflow. Start with requirements rather than assuming a form attachment provides the needed boundary. ## Decide which documents the firm needs Ask the attorney to define the stage at which the firm requests files, the permitted categories, and the required identity or matter checks. Keep the reason for each requested category in the internal brief. ABA Model Rule 1.6 includes reasonable efforts to protect representation information from unauthorized access or disclosure. Have counsel apply the jurisdiction's actual rules and other duties to the proposed collection process. Do not ask a website builder to decide whether a person should submit sensitive records. Give the builder the approved administrative path and an explicit review owner. ## Specify storage and access Ask the provider to document where files remain and how staff receive notice. Identify whether notices contain files, links, or only a receipt. Record who controls each destination. OWASP recommends authorized uploads, permitted file types, size limits, and protected storage. Its guidance prefers a separate storage host or storage outside the public web root. It warns that a supplied Content-Type value is insufficient to establish file safety. Use those technical recommendations to question the proposed implementation. They do not certify the security of a vendor or replace the firm's legal review. | Requirement | Evidence to request | | --- | --- | | Submitter permission | Approved identity and access process | | File handling | Type, content, name, and size controls | | Staff access | Named roles and demonstrated restrictions | | Storage | Provider documentation and configured location | | Notifications | Exact recipients and information included | | Retention | Approved duration and handling of copies or backups | | Failure | Clear visitor instruction and staff escalation route | Keep unsupported provider claims unresolved. Do not advertise a secure portal from a sales description alone. ## Test with harmless files Arrange a controlled demonstration using synthetic documents in an approved test environment. Do not upload real medical records to test a new route. Have the maintainer demonstrate an authorized submission, a rejected disallowed file, and the agreed size limit. Use benign test files and provider-supported methods. Do not probe a live service without its owner's authorization. Require the intended staff member to locate the correct test file. Ask for evidence that an unapproved role cannot retrieve it. Record each observation separately. ## Keep the public instructions accurate Explain who should use the upload path and what they should send using attorney-approved wording. State what successful receipt means in the implemented process. Avoid promising case acceptance, legal review, or a response time because a file arrived. Give visitors the firm's approved route for problems without instructing them to email sensitive documents as a default fallback. Retain the approved instructions, configuration, and test evidence.
