# HTS footnotes and chapter notes: preserve the references in a retailer tariff review

A copied rate cell leaves out the path that makes an HTS row understandable. For a retailer preparing a broker review, the useful task is retaining the approved code's surrounding descriptions, units, markers, and referenced notes. A single spreadsheet value cannot carry all that context.

Begin with the product specification and classification your broker already reviewed. Build a source map around that record. Keep the broker's earlier conclusion separate from the schedule text you collect today. A new source reading is evidence for review, not a replacement classification.

This guide proposes a retailer evidence bundle. It makes no preference eligibility decision, calculates no payable duty, and supplies no customs filing instruction. The [retail and ecommerce page](/for/retail-and-ecommerce) describes adjacent office work. The [retail intelligence overview](/intelligence/retail-and-ecommerce) explains the broader tariff-text comparison idea.

## Read the hierarchy before labeling the row

The [USITC FAQ, “What do all the columns mean?”](https://www.usitc.gov/harmonized_tariff_information/frequently_asked_questions) describes headings, subheadings, statistical suffixes, article descriptions, quantity units, and duty columns. It explains that indented provisions sit within the scope of their parent heading. Preserve that hierarchy when preparing the evidence.

A row whose description says “Other” is an obvious reason to retain its parent path. Copying the final description into a product worksheet can hide which broader category the source is discussing. Keep every relevant parent description between the approved provision and the heading.

Record the source number and description as text. Keep punctuation and leading zeroes. If a spreadsheet reformats the number, retain an unchanged source copy so the broker can identify what was supplied.

The FAQ distinguishes the eight-digit legal provision from the ten-digit statistical reporting number. Your worksheet should preserve the code exactly as supplied by the broker, with its approval reference. Do not shorten or extend it to make columns look uniform.

The same FAQ explains that section and chapter titles serve as references without legal significance. The rules, relevant legal notes, and heading and subheading terms have a different role. A chapter title that sounds like the product cannot establish a classification. Retain the actual text the broker needs to review.

## Keep the column label beside the value

The FAQ identifies column 1-general, column 1-special, and column 2 under Rates of Duty. Keep the original labels in any table you prepare. A value without a label invites someone to read one column as a universal result.

For special rates, the FAQ describes program criteria in general notes and a shipment claim. That explanation is a reason to preserve symbols and references for the broker. It is not evidence that a retailer's product meets those criteria. Do not select a special rate because its number looks preferable.

The Unit of Quantity column also needs its own field. The FAQ explains that it supplies reporting units and that some provisions have multiple units. Preserve all units shown rather than selecting the one most familiar to the buying team.

When using the [2026 Revision 21 JSON file](https://www.usitc.gov/sites/default/files/tata/hts/hts_2026_revision_21_json.json), retain the field names alongside your display labels. The inspected file contains `general`, `special`, `other`, `units`, and `footnotes` fields. Keep an empty value distinguishable from an explicit source value.

Do not label the JSON field `other` with an invented interpretation. Use the official table and FAQ to explain the displayed column structure. If your export does not show enough context to reconcile a field, leave the display mapping unresolved for review.

## Distinguish reference markers from legal notes

The [FAQ section on endnotes, footnotes, and compiler's notes](https://www.usitc.gov/harmonized_tariff_information/frequently_asked_questions) describes these as reference aids. It states that their presence or absence has no legal effect. The footnote text does not change the legal text or its interpretation.

The FAQ distinguishes endnotes in chapters 1 through 97 from informational footnotes in chapters 98 and 99 and the general notes. It also distinguishes those reference aids from legal section, chapter, and subheading notes, including Additional U.S. Notes. Preserve the publisher's terminology when identifying the item collected.

That distinction changes the worksheet. Use separate fields for a marker's displayed text, its location, its referenced destination, and the legal text found there. Do not compress all four into “footnote applies.”

The FAQ describes endnotes in different columns as directing readers to different types of additional information. A marker in a description and one in a rate column should therefore retain their locations. Even identical-looking symbols can become ambiguous when copied without their original columns.

A missing marker does not prove the absence of relevant legal requirements. A present marker does not prove that a referenced provision applies to your product. The source map preserves the path for qualified review; it does not resolve the path automatically.

## Collect a source map rather than a pile of screenshots

Give each item in the bundle an evidence identifier. The first item identifies the edition and approved product record. Further items identify the row, parent hierarchy, note text, and referenced destination. Each item should show where it came from and when you retrieved it.

Use the [USITC archive](https://www.usitc.gov/harmonized_tariff_information/hts/archive/list) to retain a named edition reference. For a comparison, identify both edition files. The [edition-date change brief guide](/articles/hts-revision-edition-date-retailer-change-brief) explains how to separate publication labels from effective-date questions.

Capture the full referenced paragraph or relevant note section in your private review evidence. Preserve the heading and identifier needed to locate it again. If you excerpt a passage for the brief, keep the complete source available and label the excerpt's boundaries.

Record unresolved destinations explicitly. For example, “reference collected; destination text not yet obtained” describes an incomplete bundle. “No issue found” describes a conclusion the incomplete bundle cannot support.

Use screenshots as supplements when they preserve indentation or marker placement that an export loses. Pair them with source links and edition references. An image without a readable identifier or retained text should remain a supporting view rather than the only evidence.

## Compare rate cells, note text, and references separately

A comparison should have separate findings for row values, legal-note text, and reference aids. This prevents a stable rate cell from becoming a claim that the entire tariff context remained unchanged.

If a marker changes, record exactly which marker and destination changed. Then collect the referenced text in both editions where available. A different reference is a reading task; do not infer that its legal consequence changed before the text is reviewed.

If a legal note changes while the row values stay the same, keep both observations. Ask the broker whether the note affects the previously reviewed product. Preserve the broker's answer with the specific product and source scope.

The [Revision 20 JSON download](https://www.usitc.gov/sites/default/files/tata/hts/hts_2026_revision_20_json.json) and Revision 21 download provide structured fields for comparing rows. Do not assume a row export alone establishes that every relevant legal note was included. Identify and retain the note source used for the review.

During our October 28, 2026 check, both downloads returned identical bytes. We observed no difference between those downloaded files and make no claim that their surrounding legal context was unchanged. The reference change below is synthetic. Keep any comparison of legal-note text unresolved until both note sources have been read.

Document omissions before recording a result. If the bundle lacks a referenced chapter or the earlier note text, label that comparison unavailable. It can still support a precise request for the missing evidence.

## Worked example: a synthetic reference bundle

This example is entirely synthetic. Product `STORE-B`, code placeholder `BROKER-CODE-B`, marker `EXAMPLE-1`, and note placeholder `NOTE-X` are invented worksheet labels. They represent no actual HTS provision, product classification, or legal requirement.

The retailer attaches the broker's earlier review and its product specification. Evidence item A contains the two named edition references. Item B retains the approved row's parent descriptions and indentation. Item C contains the displayed rate fields and units without selecting a payable rate.

In snapshot A, the example reference aid points to placeholder NOTE-X. In snapshot B, it points to placeholder NOTE-Y. The worksheet records “reference destination differs.” It does not record “additional duty applies” or “rate increased.”

Item D preserves both marker readings. Item E contains the hypothetical NOTE-X text supplied for the example. NOTE-Y remains unavailable. The bundle therefore states that the destination comparison is incomplete and asks the broker what text is needed next.

The retailer also lacks confirmed origin evidence for the current product batch. That gap appears under product and entry facts, separate from the missing source text. Keeping the two gaps distinct prevents a source download from appearing to resolve a supplier-document problem.

The buyer can hand over a useful brief despite those unresolved items. It identifies the observed change, the evidence retained, and the exact unanswered questions. The broker can request the missing note and product records without reconstructing the entire research trail.

## Reject the one-cell tariff conclusion

In a second synthetic example, a purchasing sheet contains a copied number under “tariff.” It has no edition, column label, unit, approved-code reference, or source marker. A buyer proposes using it to confirm that the next shipment's treatment is unchanged.

Reject that conclusion. Preserve the copied value as an unattributed worksheet entry, then request its source. Do not guess which column supplied it. Do not attach a current reference marker to the historical value as though both came from the same reading.

A second rejected shortcut treats a special-rate symbol as proof of eligibility. Record the symbol and referenced general note for broker review. Keep eligibility unresolved until the qualified reviewer has assessed the relevant facts and documentation.

Also reject a rule that says any footnote automatically overrides a chapter note. The FAQ's distinction between reference aids and legal text does not support that shortcut. Ask the reviewer to identify the controlling text and explain the decision for this product.

These rejected examples belong in the worksheet instructions. They help staff recognize an incomplete handoff before it turns into a purchasing direction. Retain the unresolved status until someone supplies the missing evidence and records the review.

## Use a worksheet with a visible completion test

The following worksheet is a recommended retailer design. It is not a publisher requirement, customs form, or substitute for the broker's review process. Adapt the evidence fields to the documents your business already keeps.

| Worksheet field | What the reviewer receives |
| --- | --- |
| Product and prior approval | Store reference, specification version, broker review reference |
| Source identity | Edition name, publication label, archive and download links, retrieval time |
| Hierarchy | Heading, parent descriptions, indentation, approved row reference |
| Original columns | Source labels, rate fields, statistical suffix, all stated units |
| Reference aid | Marker, column location, exact destination, original terminology |
| Legal-note evidence | Relevant note identifier, edition, source link, retained text reference |
| Comparison finding | Separate row-value, note-text, and cross-reference observations |
| Missing source evidence | Unread annexes, unavailable earlier text, failed source reads |
| Missing product facts | Materials, function, origin evidence, or other requested documents |
| Missing entry facts | Questions requested by the broker, with unknowns left visible |
| Review decision | Reviewer, date, product scope, source scope, reason, unresolved items |

The completion test is practical: another person can trace every observation to a retained source and distinguish it from the broker's conclusion. A complete evidence collection can still have an unresolved applicability question. Use separate statuses for those two conditions.

Keep the source map and reviewer corrections in a location your business controls. The [business memory guide](/articles/business-memory-for-ai-agents-guide) explains how reusable records support later work. For tariff review, reuse should preserve the source scope and unknowns rather than circulate an old rate cell.

Scale With Search can scope a collection and review workflow around one approved product record. The starting deliverable is an inspectable source bundle and a clear handoff to your broker.
