# Financial advisor AI rules: data, approvals, and spend

Write advisory-office AI rules for a specific function. Name the client records it may read, the qualified reviewer, the permitted output, and the budget. Keep advice and account actions outside a basic paperwork-preparation task.

Start with the firm's actual regulatory position. An investment adviser, a broker-dealer, and a practice operating under state rules need an accurate account of their obligations. A generic policy cannot settle that scope.

The [financial advisor page](/for/financial-advisors) outlines administrative examples. This article provides a proposed control plan for those functions. Have the firm's compliance owner adapt it to the registrations, services, contracts, and records involved.

## Identify which rules govern this firm

FINRA Notice 24-09 reminds member firms that existing obligations apply when they use AI, including third-party technology. It addresses supervision and public-communication standards. Those statements concern FINRA member firms. [FINRA AI notice, checked 2026.10.26](https://www.finra.org/rules-guidance/notices/24-09).

The SEC's Regulation S-P amendments require covered institutions to maintain incident-response policies and procedures for customer information. The SEC announcement includes registered investment advisers among the covered institutions. Determine the firm's actual SEC or state regulatory status. [SEC Regulation S-P announcement, checked 2026.10.26](https://www.sec.gov/newsroom/press-releases/2024-58).

Ask compliance to record the applicable requirements before approving a client-data workflow. Include relevant state requirements where they apply. Do not describe a workflow as compliant merely because it uses an account sold to businesses.

Write the regulatory review as a decision with an owner and a scope. Revisit it when the function, data classes, provider, or firm's services change. Preserve the source and configuration reviewed.

## Separate public references from restricted client records

Build an allowed-input register for each function. List the fields it needs and the reason it needs them. Exclude the rest by design.

| Record | Proposed handling for an administrative function | Owner |
| --- | --- | --- |
| Approved office services and meeting instructions | Reusable reference after review | Office manager |
| Client-specific approved action list | One-client access for the named task | Qualified adviser |
| Account statements, tax records, and identity documents | Restricted; excluded unless separately necessary and approved | Compliance and record owner |
| Bank instructions and account credentials | Excluded from drafting inputs | Authorized financial administrator |
| Marketing text and disclosures | Separate publication workflow | Designated compliance reviewer |

Use a received-file index where the task only needs document status. Do not upload the underlying statement to ask whether a statement was received. Keep the distinction between an inventory and a substantive review visible in the result.

Apply the same boundary to attachments, temporary files, search indexes, and receipts. A minimal client reference in a log is preferable to duplicating an entire client narrative.

## Approve the service arrangement before the connection

Have the technical and compliance owners inspect the exact account and configuration. Record permitted users, input retention, support access, subcontracted processing, export, and deletion arrangements. Identify who can enable another connection.

Check that the service's written terms match the intended use. Treat a proposed model switch as a reviewable change. Preserve the same data boundary even when another provider offers a cheaper request.

For a first pilot, approve one narrow input path. Keep account credentials and transaction permissions disconnected. Use fictional client material until the data arrangement is accepted.

Require a visible stop when the approved service is unavailable. The function should not move client information into another account to finish the job. Keep an ordinary staff process available for work that cannot wait.

This is a recommended service-review process. It does not replace the firm's legal analysis or establish that a particular provider meets its duties.

## Keep instructions separate from discussion

Choose the current adviser-approved action list as the controlling source for follow-up preparation. Keep meeting notes labeled as discussion unless the firm has accepted specific actions from them.

Require the function to copy the instruction's meaning without expanding it. A request to obtain a document cannot become a recommendation to change an account. A topic raised during a meeting cannot become permission to trade.

Preserve unresolved status. A file received is not automatically reviewed. A draft prepared is not sent. A proposed appointment is not confirmed. Give each state a distinct field that staff can maintain.

Test a withdrawn instruction beside an older active version. Require the function to use the designated current record or stop on uncertainty. Keep a source reference beside every proposed follow-up item so the reviewer can check it directly.

## Name the qualified approver before any output leaves

Assign a reviewer for each output class. An administrator can check document references under the firm's rules. The qualified adviser reviews substantive statements. The designated compliance reviewer handles material within the firm's publication process.

Require review of the final message, client identity, recipient, account, attachments, and source versions. Do not allow an approved template to substitute for approval of an actual message where this function requires that review.

Keep account changes, transactions, money movement, and recommendations outside the administrative function. A draft should have no tool permission to execute them. Test that restriction directly with a fictional request.

For FINRA member firms, the notice explains that communication standards apply to AI-generated content as well as human-generated content. [FINRA Notice 24-09, checked 2026.10.26](https://www.finra.org/rules-guidance/notices/24-09). Route proposed public text through the firm's actual review process rather than labeling it office administration.

## Enforce a budget for each function

Give the document checklist, follow-up preparation, and internal reporting functions separate model-spend allowances. Name a budget owner and an alert recipient. Set input-size, per-run, and retry limits.

Before each paid request, check remaining allowance and reserve its permitted maximum cost. Include in-flight requests in the calculation. When the next request cannot fit, stop and leave a budget-held result for staff.

Each receipt should identify the model, function version, source references, result, and cost. Mark an initial cost as estimated if final billing is not yet available. Reconcile it with usage records, including failed attempts and approved reruns.

Keep hosting, storage, and other service charges on separate cost lines. A model-spend cap should not be presented as a cap on every supplier invoice. Define how the firm reviews the complete operating cost of the function.

## Test a changed client instruction

Create a fictional client whose approved action list requests one document. Put an earlier discussion note beside it that mentions several possible account changes. The function should prepare only the accepted administrative request. It should neither recommend the changes nor describe them as instructions.

Then replace the accepted action with a recorded hold. Repeat the run and require a visible held state. Check the saved draft queue as well as the displayed result. An old draft should not remain available for sending as though its source were still current.

Have the qualified reviewer compare the output with both source versions. Record why the second result differs. This gives the firm a concrete acceptance example for changed authority, without using actual client information or account access.

## Preserve evidence without creating another client archive

Keep the minimum receipt needed to explain what happened. Record the approved source identifiers, review state, output reference, and any block. Restrict receipt access under the firm's record policy.

Have compliance set preservation and disposal requirements for the actual records involved. Do not let a general deletion timer remove required evidence. Keep source records and derived copies inside the approved retention plan.

Define an incident route before launch. A suspected wrong-client output or unauthorized disclosure should stop the function and reach the designated incident owner. That person applies the firm's response process and determines any required notification.

At acceptance, test two fictional clients, conflicting actions, an unauthorized attachment, a missing reviewer, a service outage, and an exhausted budget. Record the observed results. Keep failed checks visible until corrected and retested.
