Build an inventory for the clinic's privacy reviewer. Separate the public service site, appointment requests, and patient systems. Do not decide the review from the tool's marketing label. Ask for evidence of the actual fields, destinations, and page conditions. ## Read the current guidance with its stated limit HHS says HIPAA rules apply when regulated entities' tracking collection or disclosures involve protected health information. The page notes a June 20, 2024 court order vacating part of that guidance. The vacated portion treated linking an individual's IP address with a visit to an unauthenticated public page about specific health conditions or healthcare providers as triggering HIPAA obligations. Do not classify every public page visit as PHI from that combination alone. Have qualified counsel or the privacy lead assess the clinic's actual setup. ## Inventory the pages and systems first List the public site, embedded scheduler, referral instructions, forms, downloads, and any transition to a patient portal. Identify the owner of each component. Do not assume an outside widget follows the clinic site's configuration. For each tool, ask the implementer to produce a test record with synthetic information: | Evidence field | Question to answer | |---|---| | Tool and owner | Who configured it and who can change it? | | Pages | Exactly where does it run? | | Trigger | Which action sends information? | | Payload | What fields and values leave the page? | | Recipient | Which company or endpoint receives them? | | Conditions | Does sign-in or a privacy choice change behavior? | | Review | Which purpose and configuration were approved? | Mark an unknown field unresolved. A vendor name alone does not complete a data-flow inventory. ## Keep patient detail out of the inspection record Use an approved test environment and invented test information. Do not copy patient messages, portal sessions, or real appointment details into a general marketing report. Ask the reviewer how technical evidence should be retained and who may access it. Keep the public website brief limited to approved configuration decisions and repair tasks. Separate an observed request from an assumption about everything the recipient stores. State what the test established and what still requires vendor or contractual review. ## Give every unresolved tool a decision owner Have the clinic decide whether a proposed tool is necessary, which pages may use it, and what conditions apply. Record the approved configuration and who implements it. Do not treat a consent banner or vendor assurance as a complete answer to every review question. Give the privacy owner the evidence needed to assess the specific collection and disclosure. If the owner cannot resolve a new tool's purpose or data flow, leave that addition outside the approved website scope until reviewed. ## Retest the configuration that was approved After implementation, compare a new synthetic test with the approved inventory. Include appointment requests, redirects, and failure states where they exist. Record the tested version and remaining unknowns.
