# CCPA collection notices for real estate website forms

A real estate website needs a collection notice that matches its actual collection practices when the CCPA applies. Start with counsel's applicability decision. Then brief the website provider on the approved notice, its placement, and its maintenance.

The CCPA requires notice “at or before the point of collection.” [Current statute, section 1798.100](https://cppa.ca.gov/pdf/20260101_ccpa_statute.pdf#page=3). Sources were checked 2026.10.22. This article supplies a proposed implementation brief, not legal advice or ready-to-publish legal wording.

## Does every real estate website need this CCPA notice?

Applicability needs review before implementation. The CPPA describes coverage tests and separate obligations for service providers and contractors. Ask counsel to assess your business, relevant consumers, affiliated entities, and processing roles. [CPPA applicability FAQ](https://cppa.ca.gov/faq.html).

Keep the written conclusion with the website requirements. A website provider should implement that conclusion rather than infer coverage from a real estate agent's job title. Use the [CCPA applicability worksheet](/articles/ccpa-applicability-agent-website) for the separate coverage decision.

## How does the collection notice differ from the privacy policy?

The collection notice addresses the collection point; the privacy policy describes broader information practices and consumer rights. The CPPA distinguishes these documents. [CPPA notice guide](https://cppa.ca.gov/pdf/general_notices.pdf).

Give the provider the approved destination for each. Keep the general policy project separate from the form-placement work so neither disappears inside the other's checklist.

## What information should the legal reviewer receive?

Give the reviewer a proposed inventory of forms, fields, recipients, storage, tracking tools, purposes, and retention decisions. Include collection outside visible form fields.

For each item, identify who can confirm its behavior. Mark an uninspected connection UNRESOLVED. Avoid asking counsel to approve a description that the technical provider has not checked.

## Which notice contents need approval?

The statute addresses collected categories, sensitive categories, purposes, sale or sharing, and retention periods or determining criteria. [Current statute, section 1798.100](https://cppa.ca.gov/pdf/20260101_ccpa_statute.pdf#page=3).

Ask counsel to approve those descriptions against the inventory. Supply the provider with the final text, its version date, and the permitted placement. Keep placeholder language off the published page.

## Should seller and buyer forms share a notice?

Share a notice only when the reviewer confirms it accurately covers both collection paths. As a proposed check, compare a seller's property inquiry with a buyer's property-search request.

Record any differences in fields, recipients, follow-up, and retention. Give the reviewer those differences before deciding whether a shared notice is suitable.

## Where should the notice link appear on a form?

Place the approved link where the visitor encounters collection. The regulations describe a conspicuous link near input fields or the submission button. [CCPA regulations, section 7012(c)](https://cppa.ca.gov/regulations/pdf/ccpa_statute_eff_20260101.pdf#page=25).

Ask the provider for screenshots of the actual form state. Review the relationship between the fields, button, and link on a phone as well as desktop.

## Is a link in the footer enough?

Have counsel review the actual collection point rather than accept a footer link as proof. For the implementation brief, require a screenshot showing the notice beside each relevant form.

Record the footer destination separately. A successful link check establishes navigation, while the legal reviewer decides whether the approved placement satisfies the applicable requirements.

## Can the notice live inside the privacy policy?

The regulations permit a direct link to the policy section containing the required notice information. Sending visitors to unrelated introductory material does not satisfy that described approach. [CCPA regulations, section 7012(f)](https://cppa.ca.gov/regulations/pdf/ccpa_statute_eff_20260101.pdf#page=26).

Test the exact section link. Require it to reach the approved text after any policy redesign or heading change.

## What should the provider inspect before someone submits?

Ask the provider to inspect page loading, form interaction, and submission separately. As a proposed inventory, include analytics requests, advertising tools, embedded booking, chat, and partially entered form data.

Record observed destinations and the event that triggered each request. Keep unobservable vendor processing unresolved until its owner supplies evidence.

## What about an embedded property-search registration form?

Include that form in the collection inventory. Ask its provider who controls the collection, which notice appears, and who maintains it.

The regulations discuss collection controlled by multiple businesses. [CCPA regulations, section 7012(g)](https://cppa.ca.gov/regulations/pdf/ccpa_statute_eff_20260101.pdf#page=26). Have counsel approve the responsibility allocation before treating an embed as covered by your website's general wording.

## Should the notice describe hidden tracking fields?

Give the reviewer the complete field inventory, including source-page references and tracking values. Ask the technical provider to explain what each value identifies and where it goes.

Do not use the visible form labels as the inventory boundary. Retain a private implementation record that maps approved descriptions to the observed collection behavior.

## How should retention wording be selected?

Use the reviewer-approved retention period or criteria for each applicable category. The statute expressly addresses both approaches. [Current statute, section 1798.100(a)](https://cppa.ca.gov/pdf/20260101_ccpa_statute.pdf#page=3).

Request confirmation from the people managing the form store, inbox, and connected systems. Flag discrepancies for review before publishing a uniform retention statement.

## Can the website provider decide whether information is sold or shared?

Ask counsel to make that classification from confirmed facts and contracts. Supply the list of recipients, advertising connections, and their stated purposes.

The proposed technical task is to document behavior. Keep the classification decision attached to its supporting facts, rather than letting a template's default sentence decide it.

## Does the notice replace newsletter permission?

Keep the collection notice and optional newsletter choice as separate review items. Ask counsel to approve their relationship and exact wording.

For acceptance, propose a seller inquiry with the optional newsletter choice declined. Require the recorded inquiry and subscription result to match the approved design. Do not infer permission from a successful submission alone.

## How should mobile readability be reviewed?

Review the notice in the same phone layout as the form. The CPPA guide calls for understandable, readable, accessible notices and appropriate language availability. [CPPA notice guide](https://cppa.ca.gov/pdf/general_notices.pdf).

As proposed checks, enlarge text, follow the link, return to the form, and inspect whether entered information remains available as intended.

## What should a keyboard check demonstrate?

Ask the provider to demonstrate reaching the notice link and its destination using the keyboard. Record the visible focus position and any barrier.

If the notice opens a dialog, include opening, reading, closing, and returning to the relevant field. These are proposed usability checks, not a declaration of legal or accessibility compliance.

## How should multiple languages be handled?

Give counsel and the translator the same approved source version. The CPPA guide discusses notice availability in the languages used for other consumer information. [CPPA notice guide](https://cppa.ca.gov/pdf/general_notices.pdf).

Ask the provider to map each form language to the intended notice. Keep the translation date and review status alongside that mapping.

## What happens when a form gains a field?

Send the change through the approved notice-review process before release. Give the reviewer the new field's purpose, destination, and retention treatment.

As a proposed control, require the implementation ticket to identify the reviewed notice version. Retest placement and links wherever the changed form appears, including copied landing pages.

## How should copied campaign forms be checked?

Inventory every published placement of the copied form. Require its approved notice link and text version to remain associated with it.

Test the campaign page independently. A provider's reusable component can be a useful maintenance choice, but accept it only after the actual published placements match the approved brief.

## What should the acceptance record contain?

Retain the form URL, screenshots, notice destination, text version, collection inventory, reviewer, and unresolved items. Use synthetic details for submission tests.

Have the responsible reviewer sign off on legal wording separately from the provider's technical checks. Avoid describing screenshots and received inquiries as a legal compliance certification.

## Who should maintain the notice after launch?

Assign a business owner for the text and a technical owner for its placement. Require proposed changes to fields, vendors, tracking, and retention to reach them.

Save the approved version with the implementation record. Give future providers that record so replacement work starts from confirmed practices and the review decision.

## What should go in the website repair brief?

Include the failed collection point, approved wording, required destination, and evidence needed for acceptance. Keep unresolved legal choices visible before implementation.

For a broken seller form, identify the affected path alongside the notice problem. Use the [seller inquiry checklist](/articles/seller-inquiry-path-agent-website) for the separate delivery test.

Bring the approved requirements and acceptance checks to your [real estate website brief](/for/real-estate). Request the work through the [written website scope](/work).
