# Store court rules and case facts so AI drafts match your prior filings.

You ask an AI assistant to draft a motion for summary judgment. The structure does not match the court's local rules. The citations follow the Bluebook where the court wants a state style. The argument order differs from your firm's template. The defined terms differ from the ones in your earlier filings for this case.

You correct each point in the chat. The next week you start another motion in the same case, and the assistant has none of it. You explain the page limits, the citation style, the argument structure, and the defined terms again.

Legal writing memory is a set of files that hold those rules and facts between sessions. The assistant reads them before it drafts. The case, parties, and judges below are fictional examples.

## List what every filing depends on

A legal draft sits inside four sets of constraints:

- **Court rules:** fonts, margins, line spacing, page limits, citation style, and procedural rules for each jurisdiction.
- **Case record:** established facts, defined terms, and positions taken in prior filings.
- **Document conventions:** the usual structure for each motion type.
- **Your style:** how you order arguments, distinguish cases, answer counterarguments, and set tone for a given judge and opposing counsel.

A chat session can hold these for one conversation. When the session ends, the constraints go with it, and the next draft starts from the model's defaults.

## Set up four kinds of file

Split the memory by what each file governs:

| File | Holds |
|---|---|
| `standards/brief-templates.md` | Structure for motions to dismiss, summary judgment motions, oppositions, and replies; standard sections; argument flow |
| `standards/court-formatting.md` | Formatting and procedural rules by court: font, spacing, margins, page limits, required tables |
| `standards/citation-rules.md` | Bluebook or state style by jurisdiction, case name format, abbreviations, parallel citation rules |
| `matters/<case>/case-file.md` | Key facts from the complaint and answer, defined terms, positions taken, discovery log, prior motions and outcomes, case theme |
| `matters/<case>/research.md` | Authority the lawyer has read and verified: full citation, holding, pinpoint pages, quotations, and the link to your facts |
| `courts/<judge>.md` | Dated observations about a judge's preferences, with the source of each observation |

## Get the structure and format right on the first draft

You need a motion to compel discovery in federal court. It must follow the district's local rule on discovery motions, Local Rule 37-1 in this example, plus your firm's house style.

You ask: "Draft a motion to compel responses to interrogatories in the Acme Products case." The assistant builds the table of contents from your template. The introduction states the relief and the grounds. The background recites the procedural history from the case file. The argument follows the disputed interrogatories in order. The conclusion asks for specific relief and costs.

Your edit time goes to substance, not structure. Record the date you last checked each court's rules; local rules change.

## Keep defined terms and positions consistent

The Acme Products case is eight months old. The complaint set the terms. The product is "the Widget-2000." The alleged defect is "the seal failure defect." Your client is "Acme" throughout. The opposing party is "Defendant CoreSupply," not "Defendant."

The case file holds these terms with the timeline, the factual allegations, the discovery to date, and prior motions with outcomes. It also states the case theme: CoreSupply had notice of the defect and failed to warn.

You ask for an argument on causation. The assistant uses the defined terms without a reminder. It cites facts from the complaint and ties them to the theme. It answers the defense's alternative causation theory with arguments that match positions you already took.

That consistency protects credibility. A brief that switches terms or contradicts a prior filing gives opposing counsel an opening.

## Reuse research you already verified

You need authority for one point: an expert opinion based on reliable methodology survives summary judgment even when opposing experts disagree. You researched this months ago. You found three strong cases in your circuit. Two have useful language, and one has facts close to yours.

`research.md` holds each case: full citation, holding, pinpoint pages, the quotation, and the analogy to your facts. When you ask for the expert section of the brief, the assistant uses these entries. It formats each citation in your jurisdiction's style, with pinpoint pages. It adds a parenthetical that links the case to your facts, and the correct signal ("see," "see also," "cf.").

Put only authority that a lawyer has read in this file. Mark each entry with who verified it and when. An AI assistant can produce a citation to a case that does not exist, or a quotation the case does not contain. Treat any authority the assistant proposes from outside `research.md` as unverified until a person pulls and reads the case.

## Build each argument from the file

Your motion to compel must show three things: you met and conferred in good faith, the objections lack merit, and the discovery is relevant and proportional.

The meet-and-confer element is procedural. The case file logs the letters, calls, and attempts to resolve the dispute. The assistant cites those entries to show compliance.

The objections are boilerplate: "overly broad," "unduly burdensome," "not proportional to the needs of the case." `brief-templates.md` holds your standard answers to common objections. The assistant fits them to the specific interrogatories.

The relevance argument ties to the theme. You must prove CoreSupply had notice, so internal messages about the seal failure defect are directly relevant. The assistant builds the argument from the case facts and the discovery authority in `research.md`.

Every argument section follows your template:

1. State the issue as a heading.
2. Summarize the rule in brief.
3. Apply the rule to the facts.
4. Cite the authority.
5. Answer the expected counterargument.

## Record judge preferences as dated observations

Your notes on Judge Martinez say she prefers short briefs to exhaustive analysis. She doubts expert opinions that stray from the witness's core expertise. She rules fast on discovery disputes and expects parties to settle them first.

For a motion before her, the assistant keeps each argument to two pages, not five. It addresses expert reliability directly. It puts the meet-and-confer record first in the motion to compel.

Another judge gets another approach. Judge Thompson's notes say he wants thorough analysis with deep citation. Judge Lee's notes say she favors party autonomy and allows broad discovery.

Write each note as an observation with a date and a source, such as a ruling, a hearing, or a colleague's report. A preference that nobody can trace is a guess. Review these files when a judge issues new standing orders.

## Draft the reply from the motion and the opposition

Defendant CoreSupply opposes your motion. It argues the interrogatories are harassing, the information is available from other sources, and the requests are a fishing expedition.

You ask: "Draft a reply brief that responds to the opposition's arguments." The assistant reads the opposition and your original motion. It answers each point. It shows the interrogatories track the scope of the complaint. It explains why the other sources are inadequate. It sets out the relevance of each request.

The reply follows your template. A short introduction states the opposition's failure to carry its burden. A point-by-point answer follows the opposition's order. The conclusion restates the relief. Citations respond to the cases the opposition cited. The reply rebuts; it does not add new arguments, because your reply conventions say so.

## Set up the workspace

The setup has three parts:

1. Claude Code, which runs in a terminal and reads files in a project folder.
2. A folder, for example an Obsidian vault, with the standards, matter, research, and court files.
3. A `CLAUDE.md` file that tells the assistant where each record lives and which file controls when two disagree.

No integration with practice management software is required. Update the case file as the matter moves: new filings, rulings, discovery, and positions. The memory then persists across sessions. Close the session on Monday, open a new one on Wednesday for the reply, and the assistant reads the same record.

## Check confidentiality and verification before you file

Two duties apply before any of this touches client work.

First, confidentiality. Case files hold client confidences. Read the AI vendor's terms on data retention and training before you put client material into any tool. Get client consent where your rules require it. The ABA's Formal Opinion 512 (July 2024) addresses competence, confidentiality, client communication, and fees for generative AI use. Second, verification. The lawyer who signs the filing owns every citation and every factual statement in it. Check each citation against the source before filing. Some judges require a certification about AI use in filings; check the standing orders for your judge. The assistant drafts. It does not file, serve, or send anything.
