You saw six patients today. Each needs a session note with treatment plan updates, progress observations, clinical impressions, and goals for the next session. An AI tool could help. You do not paste patient information into ChatGPT. Protected health information in an unapproved tool is a HIPAA problem, an ethics problem, and a license risk. So you write every note by hand. At 15 minutes a note, six notes take an hour and a half after a full day of sessions. There is a way to get documentation help inside HIPAA's rules. It starts with one correction. ## Local files do not mean local AI Some setups keep context files on your computer and call that local. The files are local. The model is not. Claude Code runs on your computer and reads files from your disk. To generate each answer, it sends the text it reads to Anthropic's servers. The same holds for ChatGPT, Gemini, and most AI assistants. A patient file in the folder is a patient file sent to the vendor. Under HIPAA, a vendor that receives protected health information on your behalf is a business associate. You need a signed business associate agreement (BAA) before any protected health information goes to it. Ask the vendor whether it signs a BAA for the specific product and plan you use. If it does not, patient data stays out. "Anonymized" is not a shortcut. The HIPAA Safe Harbor method, in 45 CFR 164.514(b), lists 18 identifiers to remove. Even with those removed, clinical detail can identify a person: a rare event, a small town, a named employer. A label such as "Patient A" does not de-identify a note that describes the rest. ## Three routes for documentation help Choose a route before you write a single file. 1. Practice context only. A file holds your modality, note format, templates, and clinical language, with no patient data. You use it with any AI tool. You write the clinical content yourself, and the model helps with structure and wording. 2. A vendor under a BAA. Patient content goes only to a tool whose vendor has signed a BAA for your plan, after your own HIPAA security risk analysis. 3. A model that runs on your own hardware. Nothing leaves the machine. Model quality varies, and you still own encryption, access control, and backups. Route 1 is the lowest-risk place to start. It saves real time with no patient data at risk. For route 2, ask the vendor three questions in writing. Does it sign a BAA for this product and plan? How long does it keep the data you send? Can you confirm that your data is not used to train its models? Keep the answers with your risk analysis. ## Why a generic model writes poor clinical notes A generic model does not know your modality. CBT therapists, DBT specialists, EMDR practitioners, and psychodynamic clinicians each use specific language, intervention frameworks, and documentation needs. It also does not know your format. You may write SOAP, DAP, BIRP, or narrative notes. Your practice setting, payers, and billing rules add required elements. Without that context, each draft needs heavy edits, and the edits take as long as a new note. ## What the practice file holds Claude Code reads a file named `CLAUDE.md` from the folder where you start it. For route 1, that file holds your practice context and nothing about any patient: - your modality and your intervention terms; - your note format and its required elements; - treatment plan templates: goal structure, progress measures, and intervention descriptions; - payer documentation elements and medical necessity language; - your writing style and terminology preferences. A synthetic example: ```text ## Practice modalities:: CBT (primary), DBT skills for emotion regulation note_format:: DAP (Data, Assessment, Plan) required_elements:: session length, modality, interventions used, response to interventions, risk assessment line, plan, next session date risk_line:: always present; never auto-filled; written by the clinician ## Language interventions:: cognitive restructuring, behavioral activation, exposure hierarchy, chain analysis, distress tolerance skills avoid:: diagnostic claims not in the chart; speculation about motives ## Treatment plans goal_format:: measurable objective, baseline, target, review date measures:: PHQ-9, GAD-7 (scores from the chart only) ## Payers continued_treatment:: symptom severity, functional impairment, progress toward goals, reason for continued care ``` Test the practice file before real use. Write a synthetic session summary with invented details and no connection to any patient. Ask for a note in your format. Check that every required element appears, that the risk line is left blank for you, and that the terms match your modality. Fix the file until the draft passes. Repeat the test whenever you change your note format or add a payer. Watch for one failure in particular. The draft fills in the risk line with a phrase such as "denies SI/HI," which the synthetic summary never said. That line must come from you. Add a plain rule to the file: "Leave the risk line as [CLINICIAN TO COMPLETE]." Then run the same synthetic summary again and confirm that the line stays blank. The file carries your clinical voice. It carries no names, dates of birth, diagnoses tied to a person, or session content. ## Four documentation jobs, before and after Session notes. Before: 15 minutes per note, written from scratch. After, on route 1: you type a short clinical summary in your own words, without identifiers. For example: "CBT session, cognitive restructuring for work-related anxiety, practiced thought record, client completed homework." Claude returns a draft in your DAP format with your intervention terms. You add the specifics in your record system, review, and sign. Treatment plan updates. Before: 20 minutes to pull prior goals, assess progress, write new objectives, and justify continued care. After: you give the goal structure and the progress summary, and Claude drafts the update in your template. You verify every objective against the chart. Referral summaries. Before: an hour to review months of notes and summarize themes and progress for a psychiatry referral. After, on route 2 only: a BAA-covered tool reads the relevant notes and drafts a summary in professional language. On route 1, Claude drafts the structure and you fill it. Continued-treatment requests. Before: you search notes for evidence of medical necessity and format it for the payer. After: Claude drafts the structure from the payer elements in your file. You supply the clinical evidence and submit. To know what you save, time one week of notes before the change and one week after. Do not count on a saving you have not measured. ## Keep psychotherapy notes out HIPAA gives "psychotherapy notes," kept separate from the medical record, extra protection. Most uses and disclosures need the patient's specific authorization. Keep them out of every AI workflow, on every route. ## Clinical responsibility stays with you The model does not diagnose, assess risk, or decide treatment. You review every draft for clinical accuracy and sign it. You write the risk assessment line every time, even when the rest of the note is a draft. Check your licensing board's guidance and your professional ethics code on AI use and informed consent. Some clinicians tell patients how AI tools are used in documentation. That is a clinical and ethical decision, not a technical one. ## What the setup contains For route 1, the setup is Claude Code, a folder you can open in Obsidian, the practice file, and note and treatment plan templates. It also includes a written workflow for the handoff from the draft to your record system. After setup, you can: - keep your modality, format, and templates in one file; - draft session notes from your own identifier-free summaries; - draft treatment plan updates and payer requests in your templates; - keep patient data inside the route your compliance review approved. Decide how long each draft stays on disk, and delete drafts once the signed note is in your record system.
