# Prepare an accessibility complaint record for a real estate website

Give your attorney the complaint and an organized account of the website it concerns. Give your developer a separate list of reproducible technical issues. Keep original observations and later repairs distinguishable.

This is a proposed preparation workflow for real estate agents. It does not determine liability, legal deadlines, preservation duties, settlement terms, or how to answer a demand. Ask your attorney to direct those decisions.

## What should the preparation packet accomplish?

It should help the reviewer identify the complaint, affected website, available evidence, and unanswered questions. Keep the original communication separate from your description of it.

Provide a short factual index. Label allegations as allegations and technical observations as observations. Leave legal conclusions to the attorney reviewing the actual matter.

## What should you do with the original communication?

Retain it in its received form and give it to the responsible attorney through an approved private channel. Include attachments, the envelope if relevant, and your record of receipt.

Ask counsel for preservation instructions before changing or disposing of related records. This article does not establish which materials must be preserved in a particular dispute.

## How should dates be recorded?

Copy dates exactly and identify their source. Distinguish when a document was written, when it arrived, and when someone reviewed it.

Flag any stated response date for counsel. Do not calculate or publish a legal deadline from this checklist. Keep uncertainty visible when the delivery or service details are incomplete.

## Which website identity belongs in the packet?

Record the domain, relevant page addresses, website owner, maintainer, and provider contacts. Identify who can authorize technical changes.

Use verified business records. Keep unrelated client files and transaction details outside the packet unless counsel requests them. Name the person responsible for collecting additional technical information.

## Should every allegation become a confirmed defect?

No. Keep the wording of each allegation separate from the result of technical testing. An evaluator may reproduce it, fail to reproduce it, or need more information.

Use those statuses in the issue list. Record the conditions tested so another person can understand what the result covers.

## What should an issue record contain?

Include the page, affected task, observed barrier, test conditions, evidence location, and review status. Use the same fields throughout the packet.

| Field | Information to gather |
| --- | --- |
| Reported issue | Accurate summary linked to the original |
| Test | Steps, browser, assistive technology, and date |
| Result | Observation with supporting evidence |
| Follow-up | Evaluator or maintainer responsible |

These are proposed record fields, not a legal filing format.

## What does the DOJ guidance say about automated reports?

It says: “A ‘clean’ report does not necessarily mean everything is accessible.” The guidance also discusses combining manual checks with automated tools. [DOJ web guidance, fetched 2026.10.22](https://www.ada.gov/resources/web-guidance/).

Attach the report with its scope and limitations. Avoid using its score as your entire account of the website's condition.

## Which technical tasks deserve attention first?

Ask the evaluator to examine the tasks identified in the complaint and the website's essential contact paths. For a real estate website, propose reviewing inquiry submission, listing navigation, and appointment access.

Have the evaluator set the test scope. This suggested task list does not establish a legal priority or a complete accessibility audit.

## How should a keyboard problem be described?

Describe the attempted task and where keyboard operation stopped. Record the control, focus behavior, page state, and steps needed to repeat the observation.

DOJ identifies mouse-only navigation as an accessibility barrier example. [DOJ barrier examples, fetched 2026.10.22](https://www.ada.gov/resources/web-guidance/). Use that reference as context while retaining the facts of the actual test.

## What belongs in a form issue record?

Capture the field, label, instruction, error state, and submission result that the evaluator observed. Use controlled test details rather than a buyer's private information.

DOJ's examples discuss labels, instructions, and error indicators for online forms. [DOJ form guidance, fetched 2026.10.22](https://www.ada.gov/resources/web-guidance/). Ask the evaluator to explain which observation supports the finding.

## How should screenshots be used?

Use them to show the visible state at the recorded time. Pair each screenshot with the page address and reproduction steps.

Ask the evaluator for additional evidence when the issue involves speech output, keyboard order, or a changing page state. Keep captions factual and avoid claiming that a screenshot establishes the full accessibility result.

## How should embedded listing tools be documented?

Identify the tool, provider, affected page, and observed task. Record whether the maintainer could inspect or change the relevant component.

Request the provider's current accessibility information and repair process. Leave responsibility and legal obligations for counsel to assess. A third-party component still needs a place in the technical inventory.

## What should the evaluator state about test coverage?

Ask for the evaluated pages, tasks, standards, technologies, and limitations. W3C's evaluation methodology describes defining scope, selecting a representative sample, evaluating it, and reporting findings. [W3C evaluation methodology, fetched 2026.10.22](https://www.w3.org/WAI/test-evaluate/conformance/wcag-em/).

Keep sampled results identifiable. Do not silently extend a limited review to every page, document, and embedded tool.

## Does this packet replace a full accessibility evaluation?

No. It organizes the complaint and available records. W3C describes evaluation as work that requires appropriate expertise and combines methods and tools. [W3C evaluation overview, fetched 2026.10.22](https://www.w3.org/WAI/test-evaluate/).

Ask the responsible evaluator what further testing is needed. Keep untested components and incomplete observations in an open-items list.

## Who should decide the repair scope?

Have the attorney and responsible website owner coordinate the response, with technical input from the evaluator and maintainer. Identify the person authorized to approve each change.

Keep the proposed repair list separate from legal correspondence. Record which changes were requested, approved, implemented, and tested instead of collapsing them into a single completed status.

## How should the original state and repairs be distinguished?

Keep a dated sequence of the observations and authorized changes, following counsel's instructions. Describe what was changed and which pages or components it affected.

Ask the maintainer to retain the relevant version identifiers and test records. Do not overwrite an earlier observation with a later passing result.

## What should a repair verification record show?

Show the original issue, implemented change, repeated test, tester, date, and outcome. Ask the evaluator to state whether related interactions were also checked.

Leave an issue open when the original failure persists or testing is incomplete. Use precise descriptions such as fixed in the tested form state rather than a broad compliance claim.

## Should the public accessibility statement change immediately?

Have its owner review proposed wording with the appropriate professionals before publication. Align any factual update with verified work and available support routes.

The existing [accessibility-statement guide](/articles/accessibility-statement-agent-website) covers that public page. Keep private allegations and legal correspondence out of its routine content update.

## Where should accessibility help requests go?

Specify a monitored business contact route and the person responsible for handling reports. Ask the evaluator to check that visitors can use that route.

DOJ discusses providing a way to report accessibility problems. [DOJ reporting guidance, fetched 2026.10.22](https://www.ada.gov/resources/web-guidance/). Record the agreed handoff without promising a response interval that the business has not approved.

## What should stay out of the technical packet?

Exclude speculation about motives, proposed settlement positions, and unreviewed legal conclusions. Ask counsel how to handle sensitive communications and access permissions.

Give the developer the technical facts needed for the authorized work. Keep distribution tied to named responsibilities rather than circulating the entire matter with an ordinary website task list.

## What questions should remain for counsel?

Ask about applicability, response handling, deadlines, preservation, communications, and the effect of proposed repairs. Provide the original documents and technical uncertainty behind each question.

This article supplies no answer on those matters. Record counsel's instructions privately and assign any resulting website work through the approved process.

## What can a real estate agent prepare for the website maintainer?

Prepare the affected page list, reproducible findings, access owner, approved repair scope, and verification requirements. Keep legal decisions with the attorney and public claims with the authorized reviewer.

Use the [real estate website scope](/for/real-estate) to describe authorized technical work. Ask for source files and test evidence with the handoff, including what remains unresolved.
